A local chapter of AAA is lobbying for new laws against texting while driving in Tennessee and nationwide. However, just because it isn’t currently strictly illegal doesn’t mean you can’t get stopped and potentially ticketed or even arrested!
If any behavior deemed as distracted driving (eating, talking, reading, applying makeup. etc.) is so distracting as to be in willful or wanton disregard for the safety of persons or property, that behavior can be classified a criminal charge of reckless driving under Tennessee law.
Police will need to provide conclusive evidence in the form of first-hand witness testimony to likely get prosecutors to charge the case. But situations like this are becoming more commonplace as new distractions like GPS systems can cause serious accidents while drivers are distracted.
If a law against texting while driving or distracted driving is passed in TN, it will likely be a civil traffic violation, similar to a speeding ticket or seat belt violation. But when that behaivor clearly crosses the line and results in drifting lanes, or an actual auto accident, you can expect to face criminal charges as a result of this action.
